Terms of Service

Welcome to VitalSite. These Terms of Service ("Terms") govern your access to and use of the VitalSite website, application, and security-scanning services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

VitalSite is operated from Israel ("VitalSite", "we", "us", "our"). For questions, contact us at support@vitalsite.io.

1. What VitalSite is

VitalSite is a software-as-a-service (SaaS) website security tool. You submit a domain you own or are authorized to test, and VitalSite crawls its pages, runs automated security checks across multiple categories (such as TLS/SSL, security headers, DNS records, exposed files, malware reputation, and known-CVE matching), and generates a prioritized report with AI-assisted, text-based remediation guidance. VitalSite is a B2B/B2C software tool sold via monthly subscription and one-time purchase. It does not generate images, audio, video, or any user-facing generative content.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Keep your password secure and notify us promptly of any unauthorized use. You may create an account with an email and password or by signing in with Google.

3. Authorized use only — acceptable use

You may only scan domains and systems that you own or are explicitly authorized to test. By submitting a domain (and, for Deep Scan, admin-panel credentials), you represent and warrant that you have the legal right and authorization to perform a security assessment of that domain.

You agree NOT to:

  • Scan, probe, or test any domain, server, or system you do not own or have written authorization to test.
  • Use the Service to attack, exploit, gain unauthorized access to, disrupt, or harm any system.
  • Attempt to use the Service for penetration testing of third-party systems without authorization.
  • Reverse engineer, resell, or build a competing product from the Service, or use it to violate any law.
  • Circumvent rate limits, plan limits, or access controls.

VitalSite performs passive, non-intrusive checks and read-only lookups. The optional Deep Scan feature (Agency tier) logs into an admin panel using credentials you provide, solely to check configuration weaknesses — it does not perform brute-force, injection, or exploitation. You remain solely responsible for ensuring you are authorized to run any scan. Misuse may result in immediate termination and may be reported to authorities.

4. Plans, billing, and taxes

Paid plans (Pro, Agency) and one-time purchases are billed through Paddle, our Merchant of Record. This means Paddle — not VitalSite — is the seller of record on your transaction and handles payment processing, billing, and the calculation and remittance of any applicable taxes (VAT/sales tax) based on your location. Taxes may be added to the listed price at checkout.

Prices are shown in USD before tax. Subscriptions renew automatically each billing period until cancelled. By subscribing, you authorize recurring charges via Paddle until you cancel. We do not collect or store your payment card details.

5. Refunds, cancellation, and downgrades

You can cancel or manage your subscription at any time through the customer portal in your dashboard (powered by Paddle). Cancellation takes effect at the end of the current billing period; you keep paid features until then and are not charged again. Refunds, where applicable, are handled by Paddle in accordance with their policies and applicable law. One-time purchases are non-recurring.

6. Service availability and changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. Third-party data sources (e.g. threat-intelligence APIs) may change or become temporarily unavailable, which can affect specific checks.

7. No security guarantee — informational reports

VitalSite's reports are provided for informational purposes to help you improve your security posture. We do not guarantee that the Service will detect every vulnerability, misconfiguration, or threat, or that following the guidance will make any system secure. A clean or high score does not guarantee a system is free of vulnerabilities. You are responsible for evaluating and implementing any changes, and for your own security, backups, and compliance. The Service is not a substitute for a professional security audit or legal/compliance advice.

8. Intellectual property

The Service, including its software, design, content, and trademarks, is owned by VitalSite and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Reports you generate about your own domains are yours to use. You may not copy, modify, distribute, or create derivative works of the Service except as permitted.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, VitalSite and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business, arising from or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to use the Service in the three months before the claim, or (b) USD 50.

11. Indemnification

You agree to indemnify and hold harmless VitalSite and its operators from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your scanning of any domain or system without proper authorization.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service unlawfully. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws rules. Courts located in Israel will have exclusive jurisdiction, except where applicable consumer-protection law provides otherwise.
